Terms of Service for PrismDrop

Cyphervine ("we," "our," or "us") operates the PrismDrop mobile application (the "App"). These Terms of Service ("Terms") govern your use of the PrismDrop app. By accessing or using the App, you agree to be bound by these Terms. If you disagree with any part of these terms, you may not access the App.

1. About the Service

PrismDrop is a physics-based mobile puzzle game built using Flutter and the Flame Engine. It offers players dynamic puzzle-solving mechanics, online leaderboards, and profile tracking. Certain features of the service may require authentication via Google or Apple Sign-In services.

2. Subscriptions, Payments & In-App Economy

PrismDrop may offer in-app purchases, cosmetic items, virtual currencies (such as Shards), and special premium features (such as the Quantum Rewind mechanism).

A. Billing and Payments

All transactions and in-app purchases are handled securely through the app store platforms from which you downloaded the App (specifically, the Apple App Store or Google Play Store). You agree to comply with the terms and billing policies of the respective app stores.

B. Subscriptions and Auto-Renewals

If applicable, subscriptions are billed in advance on a recurring periodic basis (such as monthly or annually). Subscriptions automatically renew unless cancelled through your app store account settings at least 24 hours prior to the end of the current billing cycle.

C. Virtual Goods and Currency

Virtual items, cosmetic tiers, and Shards obtained in the App represent a limited, non-transferable, revocable license to use those features solely within the App. These virtual elements have no real-world monetary value, cannot be redeemed for cash, and are subject to the policies set forth in these Terms.

3. EU Consumer Law (European Union Users)

Right of Withdrawal

If you are a consumer residing in the European Union (EU) or European Economic Area (EEA), you have a legal right to withdraw from digital purchases within 14 days without giving any reason.

Immediate Waiver Exception: By downloading or accessing digital content, virtual currency (Shards), or premium upgrades immediately upon completing your purchase, you explicitly consent to the immediate supply of this digital content and acknowledge that you waive your 14-day right of withdrawal once delivery or consumption has commenced.

Online Dispute Resolution

If you have disputes regarding online purchases, you may access the European Commission's Online Dispute Resolution (ODR) platform at https://ec.europa.eu/consumers/odr.

4. United States Legal Compliance

Arbitration Agreement

You and Cyphervine agree that any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, or the use of the App, shall be settled by binding arbitration, except that each party retains the right to bring an individual action in small claims court.

Class Action Waiver

You and Cyphervine agree that each may bring claims against the other only in your or its individual capacity and not as a plaintiff or class member in any purported class or representative proceeding.

5. Intellectual Property

The App, its code, assets, physics engine parameters, design systems, visual style (including the neon-gelatinous theme, Starfield assets, and custom soundscapes), and intellectual property are owned exclusively by Cyphervine and its licensors. You may not copy, reverse engineer, or redistribute game assets without written permission.

6. Limitation of Liability

To the maximum extent permitted by applicable law, Cyphervine shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, use, or goodwill, arising from your access to or use of the App, or any server outages, database errors, or data sync issues.

7. Account Deletion and Reactivation

You have the right to request the deletion of your account and all associated profile, score, and leaderboard records at any time. To do so, you can submit a request through our Account Deletion Request Page or use the option in the game settings.

Upon submitting an account deletion request:

  • Your account status will enter a pending deletion phase.
  • It may take up to 30 days to fully remove your data, scores, and cloud profiles from active databases and backups.
  • Account Reactivation: You can cancel the deletion request and reactivate your account at any time during this 30-day period by simply signing back into the App. Signing in will restore your profile data, leaderboards, and high scores.

8. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of modifications by posting the updated Terms on this page. Your continued use of the App following updates constitutes acceptance of the new Terms.
